This past year or two, we have seen more lawsuits filed in the circuit courts of Illinois by unit owners against community associations, individual board members, and/or management companies than in years past. For this reason, we often talk about trends in the courtrooms and how judges rule in cases involving community associations. However, we cannot forget to monitor the decisions made by the Human Rights Commission or the appellate court related to charges of discrimination.
