Can an HOA Evict a Homeowner?

Yes. Under Illinois state law (765 ILCS 605/9.2), a homeowners’ association can ‘evict’ a member from their unit in order to recover past due assessments. If your community is considering eviction as a remedy, an experienced Chicago HOA/condo lawyer can help.

What is an HOA Eviction?

In Illinois, community associations have the authority to collect delinquent assessments through a ‘forcible entry and detainer action’—or as it is more commonly known, an eviction. Though, an HOA eviction is somewhat different than an eviction of a tenant.

With an HOA eviction, the association must obtain an ‘Order of Possession’ from an Illinois court. When this order is in place, the HOA will have the legal authority to, at least temporarily, take control of the individual owner’s unit. From there, that unit can then be rented out in order to recover the full assessments that are due.

Initiating the Eviction Process Can Often Produce Results

If your board is struggling to recover the assessments that are owed, you may be wondering: What can the association do to collect the money from the unit owner? AN HOA eviction may be the answer—it can be an especially effective tool to get a unit owner to pay the full amount that they owe.

In many cases, the threat of eviction is sufficient to get payments. In Illinois, HOAs and condo associations must comply with strict notice requirements before evicting a unit owner. Delinquent owners often begin making payments after receiving a notice. What happens if the homeowner does not comply with the notice? The HOA can pursue their rightful remedy and move for an Order of Possession.

How Can a Lawyer Help with an HOA Eviction?

HOA evictions are notoriously complex. No association wants to make a mistake and end up stuck in protracted litigation. After all, the goal is ultimately to collect unpaid assessments in an efficient and cost-effective manner. An experienced Illinois HOA eviction lawyer can help. At Keough & Moody, P.C., our attorneys are prepared to:

  • Conduct a comprehensive review of your case;
  • Explain your rights, options, and available remedies to collect any unpaid assessments;
