In Illinois, community associations have the authority to collect delinquent assessments through a ‘forcible entry and detainer action’—or as it is more commonly known, an eviction. Though, an HOA eviction is somewhat different than an eviction of a tenant.
With an HOA eviction, the association must obtain an ‘Order of Possession’ from an Illinois court. When this order is in place, the HOA will have the legal authority to, at least temporarily, take control of the individual owner’s unit. From there, that unit can then be rented out in order to recover the full assessments that are due.
